Maine Department of Health and Human Services, Division of Licensing and Certification (DLC) is the current licensing source for Maine Behavioral Health Organizations. DLC licenses mental health and substance use disorder treatment programs under 10-144 CMR Chapter 123, the Behavioral Health Organizations Licensing Rule.
Licensing Requirements
To operate a behavioral health treatment program in Maine, providers should use the current DLC Behavioral Health licensing materials. A Behavioral Health Organization can hold a mental health license, a substance use disorder treatment license, or both. If a provider offers both mental health and substance use disorder treatment, DLC currently instructs providers to use separate applications.
For IOP services covered under MaineCare Chapter II, Section 65, Maine DHHS says providers must have the appropriate Chapter 123 service on their DLC license and then obtain program approval from the Office of Behavioral Health.
